Terms & Conditions

These Terms of Use ("Terms") govern your access to and use of [popularparty.net] and any related services (the "Site"), operated by the Popular Party ("the Popular Party," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Who we are

The Popular Party is a political organization. You can reach us at lucaspeters@popularparty.org.

Eligibility

You must be at least 18 years old to make a donation or purchase through the Site. By using the Site, you represent that you are able to form a binding agreement with us and that you will comply with these Terms and all applicable laws.

Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;

  • attempt to gain unauthorized access to the Site, its servers, or any related systems;

  • interfere with or disrupt the Site or its security;

  • use any automated means to access or collect data from the Site without our permission; or

  • impersonate any person or misrepresent your affiliation with any person or organization.

Donations

Donations to the Popular Party are voluntary. By making a donation, you certify that:

  • you are a U.S. citizen or lawfully admitted permanent resident;

  • the donation is made from your own funds and is not reimbursed by any other person or entity;

  • you are not a foreign national;

  • you are using a personal payment method drawn on funds belonging to you; and

  • you are at least 18 years old.

Donations to the Popular Party are not tax deductible. Except as required by law or as we otherwise determine in our discretion, donations are non-refundable. You authorize us and our payment processor to charge the payment method you provide.

Merchandise

If you purchase merchandise through the Site, your purchase is a retail transaction and is not a political contribution. Prices, availability, and shipping terms are as described at checkout.

Intellectual property

The Site and its contents — including text, graphics, logos, designs, and the writings and publications of the Popular Party — are owned by the Popular Party or its licensors and are protected by copyright, trademark, and other laws. "Popular Party" and our logos are our marks and may not be used without our written permission.

We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Site for its intended purpose. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission, except as expressly permitted by law.

Your submissions

If you submit any content to us — such as messages, volunteer information, or other materials — you grant us a non-exclusive, royalty-free, worldwide license to use, store, and process that content for the purposes of operating the Site and carrying out the work of the Popular Party. You represent that you have the right to provide the content and that it does not violate the rights of any third party or any law.

Third-party links and services

The Site may contain links to, or rely on, third-party websites and services, including payment processors and email platforms, which are governed by their own terms and policies. We are not responsible for third-party websites or services.

Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, the Popular Party and the people acting on its behalf will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of your use of or inability to use the Site.

Indemnification

You agree to indemnify and hold harmless the Popular Party and the people acting on its behalf from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms or any law.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.
